Stratford Conservatorships Lawyer
It’s not uncommon for a person to want someone else to manage their financial affairs for them. That management often requires legal authority. That authority is called a conservatorship and it can apply in situations ranging from someone who voluntarily requests a conservator to have this authority to seeking it on behalf of someone who may be mentally or physically incapacitated. Our Stratford conservatorships lawyer will lead clients through the legal hurdles that mark the path to conservatorship.

It should be noted that conservatorship applies strictly to the care of one’s finances. It is not to be confused with guardianship, which involves the legal authority to care for someone’s physical well-being.
The conservator will typically handle the money that pertains to someone’s housing, food, and medical care. The conservator will likely deal with day-to-day expenses, ranging from transportation to recreation.
It’s also possible—especially in situations where the person being cared for is a minor—that the conservator may need to finance education. All of this means the conservator necessarily needs access to everything from bank accounts to stock portfolios. That takes legal authority.
Don’t neglect the important legal steps that have to be taken to protect your assets, and those of your family. Get the help you need by calling Attorney Thomas E. Brennan at (203) 806-9065 or by filling out our online contact form to arrange for a consultation.
How to Become a Conservator
Our Stratford conservatorships attorney can file a petition with the court seeking the requisite legal authority. The petition will be heard by the Probate Court. If the petition is on behalf of someone who has become mentally incapacitated, the Court will appoint a representative to speak on behalf of that person.
The Court will need to be shown that the individual for whom conservatorship is requested can no longer care for themselves. It’s quite likely a doctor will need to testify in this regard. Depending on the circumstances, it’s possible there may be a dispute over whether conservatorship is needed, or who the conservator is to be. In that event, more documentation and testimony may need to be introduced as evidence.
